  • Your personal data are collected and processed by the Data Controller:

      • for the execution of the services and functionality of the APP;
      • for the fulfillment of legal obligations;
      • for the pursuit of the legitimate interest that the Data Controller has found to exist on the basis of the balancing of interests carried out;

• Provision of data
  • The provision of data for the purposes referred to in point 3 lett. a) it is necessary to use the requested services.
• Processing methods
  • The processing of your personal data will take place with or without the aid of computer systems. The Data Controller undertakes to guarantee the logical and physical security and confidentiality of the personal data processed, putting in place all the technical and organizational measures appropriate to the processing.
• Data retention
  • Your personal data will be processed and stored for the time necessary to pursue the purposes for which they were collected and in any case within the statutory limitation times. Once the storage time has elapsed, your data will be deleted and / or anonymized to be used for statistical purposes.

TERMS AND CONDITIONS FOR TRIAL USE OF THE "BKube" APP

• Object
  • 1.1 These terms and conditions (hereinafter "Terms and Conditions"), together with the relative Privacy Policy, govern the use for a free trial ("Trial") of the "BKube" APP (hereinafter "APP"), available for IOS and Android operating systems and usable through smartphones and mobile devices, and the relationship between the user (hereinafter "User/s") and the owner of the APP, Telmekom Srl.
  • 1.2 Telmekom S.r.l. (Tax Code and VAT number 02621100219) based in Lana (BZ) via Dr. Jakob Koellensperger, 4 has the following Terms and Conditions and is hereinafter referred to as the "Company" for the sake of brevity.
  • 1.3 The Trial period starts from the date of effective activation by downloading the APP and registering the User and ends, without renewal or extension unless otherwise agreed, on [•].
  • 1.4 The APP allows Users, only if they are of legal age, to access the BKube boxes ("Station/s") for the storage of their bicycles (the "Service/s").a
  • 1.5 The use of the APP is subject to the control of the User himself and is reserved for strictly personal use with the exclusion of any commercial purpose by the User.
  • 1.6 The User who accesses the APP is required to carefully read the following Terms and Conditions.
  • 1.7 By downloading the APP on their device, the User explicitly accepts these Terms and Conditions of use of the APP.
  • 1.8 The use of the APP and the Services is free for the Trial period.
• Content and use of the APP
  • 2.1. The content of the APP has been compiled with the utmost diligence. The Company does not guarantee that the data is always correct, complete or updated.
  • 2.2. In order for the User to be able to use the APP, the device on which to install the APP must be equipped with adequate functional capabilities and network operations. It may also happen that the APP and the connected Service are limited from a geographical point of view due to reception and transmission problems of the network provider's infrastructure or interference caused by atmospheric conditions, topographical characteristics, as well as by the position of the network provider. User's device.
  • 2.3. The APP can be consulted 24 hours a day, 7 days a week throughout the year, however, the Company cannot be held responsible in any way if, for any reason, it is not accessible and / or operational at any time or for any period. Access to the APP may be suspended temporarily and without notice in the event of system failure, maintenance, repairs or for reasons completely unrelated to the will of the Company or for events of force majeure.
  • 2.4. Some APP Services are linked to the geolocation function, which allows you to use the Services in an optimal manner. The location of the device depends on the user's data services and connectivity and is in no way attributable to the APP.
  • 2.5. Any damages that may arise to third parties from the use of the APP by the User are the sole responsibility of the User and no responsibility can be attributed to the Company which, in any case, the User undertakes to hold harmless and harmless from any request or claim made by anyone in this regard, including expenses and fees for its legal defense.
• Use of the Services
  • 3.1 The Services are accessible 24 hours a day, 7 days a week, at each Station, except in cases of force majeure or decisions of the competent authorities that involve a total or partial, temporary or permanent restriction on the use of one or more stations.
  • 3.2 The collection and storage of the User's bicycle from the Station can only be done through the use of the appropriate APP function.
• User obligations
  • 4.1 The User undertakes to:
    • use the Services and, therefore, the Stations, with diligence, in compliance with current legislation and these Terms and Conditions and, in particular, not to change the intended use of the Stations.
  • 4.2 The User is prohibited from:
    • damage and / or modify the Stations or engage in any behavior capable of damaging them;
    • transfer the use of the Services to third parties;
    • causing damage to third parties / things / animals by using the APP and therefore the Services;
    • use the Stations in violation of current legislation.
• User Responsibility
  • 5.1. The User is exclusively responsible for all direct or indirect damage caused to third parties / things / animals as well as to himself or to his own things and / or animals as a result of and / or as a consequence of the use of the APP and the Services. connected.
  • 5.2. The User is solely responsible for cases of loss, damage, theft of objects and / or animals present in / near the Stations.
  • 5.3. The User undertakes to indemnify and hold harmless the Company and its successors in title from any administrative sanction and / or any action / claim coming from third parties or any authority as a result of facts attributable to the User and connected to the use of the APP and Services.

• Applicable law and competent court
  • 7.1. Any dispute arising from the use of the APP is understood to be governed by Italian law. For the solution of disputes relating to the interpretation, execution or termination of these Terms and Conditions, the territorial jurisdiction is that of the forum where the User, as a consumer, has established his residence or elective domicile.
